Sasuke's crimes are nowhere compared to Obito's crimes
Unlike Obito. Sasuke didn't attack Konoha or kill as many people as Obito did.

Killed Kushina and Minato, The Hokage

He didn't kill anyone in the war excluding White Zetsus
After still dissipated the Mugen Tsukuyomi. Saving the humanity to become white zetsus.
Without Sasuke's participation in the War the whole world would be destroyed. This is more than sufficient to sasuke gain his pardon.
Oh Yeah. Obito wasn't punished too.

Well this isn't a punishment. Since in afterlife he was rewarded with Rin and Obito still gets to spend the rest of his afterlife with her.
Obito achieved his biggest dream despite all the atrocities he did in life.
Obito deserved to burn in hell forever to pay his sins not be rewarded in afterlife with Rin.

Madara killing Sasuke was actually a plot device for him to get the powerup because had he used Susanoo before landin there was no way he could be stabbed.
Madara has long since been surpassed by Sasuke
