I hope people don't believe killing is what makes a ninja a criminal, but it's the fact that they abandoned their village or whatnot that makes them criminals. Kakashi alone has killed many yet he isn't a criminal, and I'm sure many ninja do kill other ninja.

there isn't just 1 way to be deemed a criminal. There's leaving the country's borders w/o the Kage's authorization, but there's also murdering fellow soldiers/citizens. And plenty of have gotten the label by doing the latter.
