That's a flashback, he doesn't have the mark anymore. Also if you're referring to the third panel, that's Anko, not Sasuke.

Itachi sealed Orochimaru's Senjutsu chakra that was in the Curse Mark. This means Sasuke can NO LONGER use any of Orochimaru's snake powers b/c he no longer has his chakra. He no longer can do a curse mark transformation b/c Itachi sealed that portion of Orochimaru that was inside Sasuke.
