Sai confirmed that Root talked to the Hokage after Danzo's passing. They know of all the underhanded dealings he had with the different nations and even with Orochimaru. Danzo had just a big a hand in Hiruzen's death as Orochimaru did and that makes him a criminal and a traitor.

The only problem I see is just that Danzo never stood trial. Sasuke killed a traitor to Konohagakure. If he didn't there would have been even bigger problems because Danzo is untouchable in Konoha because of his abundant followers.
