Better question would be why Nagato was able to use Rinnegan while being Edo. I think Kabuto created Edo Nagato without Rinnegan (because Edo recreates only DNA, and the eyes werent his) then he had Rinnegan transplanted from Edo Madara (his eyes regenerated anyway) or Kabuto took Nagato's DNA from his tomb and also took a part of Rinnegan's DNA allowing him to create Edo Madara, because Madara real corpse was in the hideout where Tobi took him after showing him his Edo assets.
