No one was suppose to eat the fruit...turning into that, may explain why...

The tree had been worshipped by humanity as a holy, supernatural being. That's why no one touched that tree and fruit. On the other hand Kaguyas intention to eat the fruit of the holy tree wasn't selfish. I don't think the author would turn her into the death god, but who knows.
