Orochimaru tried taking over Itachi's body but was dominated by Itachi instead. Orochimaru was removed because of this.

Kakuzu on the other hand killed 2 other unknown members but he got no penalty whatsoever... He even attempts to kill Hidan. With no penalty

Deidara also has a grudge against Itachi and he even attacked Tobi when battling Sasuke. Deidara died but i doubt he would of been removed from the akatsuki.

Sasuke killed Itachi and was then accepted as an akatsuki member aswell along with Karin even though they both worked for Orochimaru.

Kabuto also worked with them even though he was a confirmed spy.

Are you stupid? Tobi knows all about this, he was the real leader of akatsuki. Also akatsuki can do whatever they want as long as they would never fail their mission..
