in ANY FICTION EVER, When a persons identity is revealed, then later shown to be otherwise, then they where never the first person. When Tobi first claimed to be madara, then was later shown to be obito, that doesnt necessarily confirm obito, but it does confirm that tobi was not madara.

Simple lack of counter-evidence is not evidence. Just because obito never outright said he was Tobi, it doesn't mean he cant have been. Sasuke never outright stated "My father is Fugaku Uchiha". That doesn't make him adopted. Especially since it was clear to everyone present that he was Tobi, so he would have no reason to confirm it.
