I think madara was free of kabuto's control from the start, same way hashirama was free of oro's control..

Madara redid edo tensei when kabuto released him from the contract.

The only plot hole is that orochimaru had control over tobirama while he didn't put a talisman in his head, cause that's supposed to be seperate from the edo tensei.

Edo Tensei is simpel

Person 1 makes a contract (like summoning jutsu) to bring one or more dead people back, the people that are brought back have to "obey" the caster of the jutsu. The Edos cant end the Jutsu even when they would know the sings because they didnt make the Contract. And in Oros case, he could control Tobirama, Sarutobi and Minato without the Talisman because of Hashis Cell that are right now in him

So no Plot Hole
