Phoenix contract is taken by a guy named Hokage, however he isn't active atm as far as I know.

And making a contract of a mythological being and making up a new animal are two completely different things. The latter has never been allowed.

It's not like you really need a Phoenix. You can just create a contract with the animal it resembles, like pretty much every bird, and then make it have Fire affinity, and make it look like a phoenix. If you're good with words, you may even manage to get it's resurrection abilities to a certain extend.
