Black Zetsu revealed all the poeple connected to the tree, will become White Zetsu. Orochimaru himself, is already technically a Zetsu, when absorbing them, he said he had "something" to acquire from them.

He's got a good point though. Oro is already a White Zetsu tecnhically so maybe he'll get releases because the Tree will think he has already been transformed

Not really, i dont think that was necessarily a curse mark but it was done to restrict Guruguru (Spiral Zetsu name).
