The people who think Orochimaru is gone are just... Dumb. If Orochimaru is gone, that means everyone else caught in Mugen Tsukuyomi is too. So he is not dead.
And also, his background on why he attacked Konoha hasn't been explained. So from a story standpoint, he's not finished either.
Some of these comments are sadly disappointing.
