No, considering Orochimaru can shed his body from any damage. So Evening elephant and Night gai will remain useless on immortal.

8gates count as a victory... Just because he dies after doesn't mean he didn't win... Hiruzen beat Edo Tobirama and Hashirama even though right after he was going to die because the reaper death seal kill/seals the user... Orochimaru could have been killed by 4tails Naruto Gai would turn Oro into dust...

A sick Oro could do it 3 times in his sick state before starting to feel worse. Now that he's ok and has Hashi's cells he must be able to do it say, 9 times (3 for the healthy state and 3 for the Zetsu body U_U).
Gai uses EE then NG and he's toast.

Orochimaru's regeneration had nothing to do with his body failing, it's just that his Fushi Tensei limit was up. I think you're underestimating Gai though, he stayed in EGM for like four chapters.

Of course, that was a weakened Orochimaru who isn't as strong as now. However, this goes to show
that Orochimaru CAN die (at least temporarily as he can always be brought back via cursed seals).
So any gates below 8 will be tanked and Orochimaru will win. Orochimaru might or might not
be able to survive Evening Elephant. Midnight Gai though is definitely enough to kill Orochimaru though.
I cannot see him tanking that at all.
In conclusion: Either Orochimaru or tie (as Gai will die the instant he kills Orochimaru via Night Moth)

I jumped to conclusions, but he surely wasn't 100% (

Even in 8th Gate, what can he do to put Oro down? He doesn't care about physical attacks :| That's my point.

First, if anyone has to say Gai opens the 8th gate for a chance of victory then those people are openly admitting that Gai is inferior to Orochimaru (which he is) and the only way Gai has a chance to win is if he suicides himself.

Orochimaru tanked dozens of punches from Tsuande already. Gai is not physically stronger than Tsunade. Gai might be equal to her when he is in his 8th Gate only. Think about it, Tsunade punched Madara one time and exploded his body in half, she lacked the speed to land this directly so yes the other Kages made diversions for her to get the opening. Gai kicked half of Madaras body off when in 8th gate mode but he did it with no help because of his immense speed. The point is Gai needed to suicide himself to achieve that kind of physical strength when Tsunade does that regularly. I don't think Gais attacks will be a problem for Orochimaru.

Oochimaru can tank his Morning Peacock, and can survive with minimal injuries, or use his Oral Rebirth
Triple Rashomon can tank the Daytime Tiger
Orochimarus body has been ripped to shreds and destroyed too many times and he just Oral Rebirths to escape death normally.
Don't forget Orochimaru has the Five Elements Seal and he could hit Gai with it sealing off his chakra permanently.

Because of the countless modifications he has made to his body it is possible. His body is very malleable and can tank many attacks. The Oral Rebirth is not limited to him just resuscitating from his mouth. If I recall correctly, Sasuke used it to escape Amaterasu and his back split open and a new body emerged from it, not his mouth. I can go check up on this to be exact but I'm pretty sure this happened.
