I think ive got it........
Maybe now tobi has itachis body he has the two legendary items, and maybe tobi can release orochimaru if he wants.
I mean think about it, tobi has power to control orochimaru easily, and orochimaru is too stubborn to listen to him, so chances are orochimaru will try to escape.
Who knows though, i liked it when orochimaru ruined things, it made for good storyline, also he was the first S class ninja we ever saw in the naruto universe, its ashame hes dead, and its ashame we know much stronger ninjas now in a sense, makes him seem almost pathetic.
And also shows how far behind pein and tobi sasuke and naruto really are.
Sasuke only captured orochimaru because he was incredibly weak on his last day in the body that was rejecting him, and naruto is no match for orochimaru yet without the kyubii 4 tails.
The problem is naruto in 4 tail mode is just raging, its easy to dodge his moves and simply run away if need be.
