Differences is Orochimaru is alive, stronger and learned from his pass fights. He didn't know Itachi's strengths before he first attacked him and after that he knew Itachi was stronger. Second fight, he knew Itachi was weakened from his fight with Sasuke and didn't know Itachi had Totsuka blade or else he would have dodged it instead of thinging he was unkillable.

Orochimaru saw everything that happened in Kabuto vs Itachi and Sasuke and learned that he was wrong for trying to define himself by gathering all the powers and information into his body and that's why he's helping Sasuke, unlike Kabuto, Sasuke didn't choose the same path as Orochimaru.

Current Orochimaru can summon and control Tobirama, Minato and Hiruzen, all who knows how to fight against an Uchiha since they either fought them before or shown to have intense knowledge of their village as a whole. Itachi's power hasn't improved while Orochimaru's power and knowledge has. I don't know who would win but to say Itachi would win by using pass fights doesn't decide the current matching. Kid Obito lose to Might Guy and Kakashi yet he was soloing Kakashi, Guy, Bee and Naruto for a good amount of time. Bee soloed MS Sasuke and Taka, does that means he can solo EMS Sasuke? No because it's not the same circumstances.

1) That was past fights, things change. Bee soloed Sasuke 2 times, can Bee still solo Sasuke now? No

2) That was in part 1, Sasuke was inferior to Gaara, is that still true? Don't think so.
