Incorrect we have seen what happens inside the body. Orochimaru binds his soul to their body. If it was simply a snake going in his body how did he enter Sasuke's body during there encounter. It isn't a difficult concept. Sasuke sliced up Orochimaru's body but Orochimaru entered Sasuke's body and mind, and all Sasuke had to do was seal Orochimaru's soul.

No, I don't think so. The manga implies that the snake body was not Oro's true body but was instead a custom made body (Oro had many of these bodies being created in test tubes in his lab shown in the Kabuto War Flashbacks). Oro even abandons the snake body when his soul enters Sasuke (That's why Kabuto calls the body a Husk).

Oro's Original body was either destroyed or Hidden away. As far as the manga goes, Oro is pure Spirit devoid of any Body. In this case, it's irrelevant what the Gender of the Body Oro takes over is. That will not be Oro's true Gender. Oro's true gender is the gender of his soul. Considering his original body was a male, The gender of Oro's soul is Male.

So, regardless of the gender of the body, what matters is the Gender of the soul. The Body is just a vessel that Oro takes over. Oro's true gender will always be Male whether the body taken over is Male, Female or Transgender.
