Orochimaru doesn't have sage mode

Your logic would have applied to Orochimaru if he used SM before. But he didn't. Sasuke used 2-3 paths out of 6. Naruto needs all 9 tailed beasts to use his RSM chakra cloak (the one he used against Kaguya).

It applies fine, we’ve SEEN adult naruto use rsm, yet because of the lack of so6p cloak, people claim he doesn’t have it

Despite having the rinnegan, and using 2-3 of the powers, people still claim he can’t use them.

It’s just the hypocrisy of people doing the opposite when it comes to their fav “oh even with proof I don’t believe that but without proof I’ll believe this... cause you know... my fav”

It also makes it even WORSE that he’s never used it, and people claim he has it

According to manga statements he completed all steps needed to enter SM, he was in Ryuuchidou, he knows the Snake Sage and now he has one of the most potent bodies in NV to overcome the only reason he couldn't use it and has several more years of practice.

Kabuto already stated that Orochimaru couldn’t enter sage mode because of his body issue. He's now inside a body created and modified with Hashirama's DNA.

But normally isn’t a statement from the characters proof enough? If a character say he can do it or can’t do it shouldn’t that be enough proof?

Curse mark IS SAGE CHAKRA.

If he can brand individuals with it, how does he not possess the requirements to control it? At the very least, he is 100% capable of it, and if he hasn't sought after that kind of power yet, he's a fool.

Why would he not acquire that power? And if he does not have it, why did Kabuto begin to look more and more like him when he used dragon sage transformation? If Orochimaru does not have sage mode, why does he have so many jutsus associated with it?

All this being said, it still isn't really confirmed he has it, but if he doesn't then it makes literally no sense.
