true i was wrong there. it was because he was inside anko because of her cursed seal.
Now with the RDS.
he cut himself to open the rds belly so you think he had to die..
but he can just transfer his soul to another body..
wich could almost happen in a instant because the body was ready and
suigetsu had grip on the body.

just look at the naruto vs orochimaru fight.
he changed his body like 5 or 6 times there.
