He is capable of beating Deva Pain. Half the answer to beating him is figuring out the time interval and coming up with a speed counter strategy which the genius oro is very capable of. Also physical harm on that level won't hurt oro. You have to remember he was split in half by the 4 tailed kyuubi with no pain or grimace at all and has taken blows from tsunade's monstrous strength and laughed it off. Oro would set Deva Pain up while getting st away not to mention if he uses his Dragon God transformation an in that case Deva would need the other paths especially the soul stealing path because the Dragon God is immortal.

Chibaku Tensei would like to have a word with you! This is the same jutsu that sealed the Juubi and would have sealed Kyubi had Nagato been at full strength. He doesn't need full strength to seal Orochimaru
