he takes itachi by itachi not being able to touch him. He has no access to the kamui dimension. I hate obito but neither nagato nor itachi have a way to touch him

Obito was easily top 5. Obito is his PRIME?

He has: The Gedo Mazo, The Six Tailed Demons (Which was not Kabuto's power.), The rinnegan, the sharingan, mokuton, katon that can easily obliterate an entire army, and speed that rivals KCM Naruto's.

Obito's at most top 3.

What the hell are you talking about? How on earth are all those people over Obito? He was easily top 3 material even without being a Jinchuriki. His Katon attacks rival Madara's. Minato at number 3? Itachi above EMS Sasuke? Since it's your opinion, I wouldn't say more, but it's a very very poor one.
