Other people have pointed out that we can't simply allow murderers and what-not to roam around the country freely killing for revenge or whatever reason, but I dont believe there is, nor should there be, a precedent for this (obito & sasuke) situation.

Sasuke and Obito were both extremely traumatized by events caused by villages. I think a proper punishment would be a life dedicated to helping the village in whatever way they could, which both actually ended up doing coincidentally, though Obito had like 20 minutes to turn his shit around

It's reformation vs punishment. These two have been reformed so some would say they should be free and that would be logical. However, I think it should be a balance of the two. They should be punished, for the sake of the sanity of the victims, through some form of atonement at the very least and time at the worst.

But we must remember that even Obito thought himself to be irredeemable and sacrificed himself while Sasuke devoted his life to serving his people. These two had it right in regards to their fates although I wouldn't say Obito was beyond redemption.

Naruto already forshadowed Obito is going to be punished in jail when he told him to come and atone for your sins
