I doubt it. A single snake escaped but burned to death. I doubt Orochimaru's soul resided within that snake. It was a single last ditch effort to survive which failed, not an escape from the totsuka. Like if a plant were to drop a seed before being sealed.

I think Orochimaru's soul resided within that snake. Or transferred his consciousness into it. Why not? Stranger things have happened.
Either way, now he's back.
