A ninja is someone who utilizes jutsu, among other non-jutsu weapons. A Samurai uses a sword exclusively, among other non-jutsu weapons. So, if you use a sword and jutsu, you're a ninja.

Well some characters are using what seems to be Katana in the NV. I seen Anbu with Ninjato which is the usual sword for Ninja.

Sasuke is using a Chokuto.

Chokuto are a very old style of sword, older than katana and tachi style blades, so having a chokuto blade with katana style fittings is not historically correct.
