He was considered a villain throughout the entirety of Part 1 and half of Part 2. Including him is fair.

Definitely Orochimaru.
Brutally experimenting on babies, treating those who viewed him as a personal Jesus and a father figure as mere pawns, toying with life and death, taking away peoples' lives to extend his own, and more.
"Evil Itachi" was pretty damn evil, but Orochimaru is in a league of his own imo.

Orochimaru takes this with no difficulty whatsoever. He experimented on babies, murdered his underlings, killed two Kages, etc.

As much as I love Itachi, he is not even on the same level as Orochimaru when it comes to the villain. Orochimaru takes this.
