Didn't Itachi technically break the summoning contract first via KA? He planned the use of it and it reacted to his MS. Itachi was already free of Kabuto's control before him and Sasuke even fought Kabuto and subsequently made him release Edo Tensei. Also, Itachi and Shisui are the only MS users (that lived past a certain age; so Izuna doesn't count) that didn't really go insane through the Curse of Hatred. Kagami as well, but I don't think it was stated that he was an MS user.

No He didn't. He layered shisui's genjutsu over edo tensai, but kabuto could have put him back in the coffin at anytime.

Yeah, cuz he broke the contract. He can't go back in the coffin. Had itachi broke contract he wouldn't have returned to pure world upon release since shisui's genjutsu commands would have kept him there. He couldn't pull a sasori.
