Actually madara was around the time the jutsu was probably invented and used since he was best friends with hashi for awhile. The rinnegan has nothing to do with breaking free its the summoning contract itself that's being broken I believe.

Sounds funny "Hashi was able too break free with Hashi cells". (but other than that, this seems most reasonable), tho a poster up had me confused with said hand seal mentions...
