I mean come on he talks about the SO6P a bunch of times and about Uchiha and Senjus. You would probally ask If the SO6P couldn't survive death how could he?

Harishma had great healing abilities. Madara even said that he got some of Harishma's cells. So Madara and Tobi met and Madara gave Tobi his Rinnegan and Harishma's cell. Or when Madara died Tobi just took it.
Tobi used Harishma's ability to escape death. Madara and the Elder son devised a plan.
Maybe the elder son wanted to have as much power as his Father. Or he was trying to prove to his death Father that he was the better man to pick instead of the younger son. So Tobi is trying to revive the Juubi to show that he did what his father couldn't.
So Madara agreed to his means and Tobi agreed to revive Madara once the deed was done. Madara might have told Tobi to use his Rinnegan and Tobi maybe couldn't withstand the power of the Rinnegan and gave it to Nagato.
