3 tomoe Sharingan Sasuke only defeated Orochimaru when he was dying in bed .
Only Edo Tensei is restricted.
No EMS sasuke feats like more stamina.
The Black Flame element is impressively haxxed.
Not only is it superior to other elements by default, but its form manipulation makes it the perfect weapon as well. It is effectively a combination of what Kakuzu and Tenten both aim for in attack. It's lingering effect also makes it useful against regeneration.
The thing is, tho, that it is still tied to its caster so its own power can be circumvented by taking out Sasuke quickly. In that game, Orochimaru is well suited. His Long Sword busts through any attack and defence and with great speed. His various elements, assuming he is healthy, allow easy feints and even redirection of the Black Flames.
So Orochimaru wins, but no one on the level of EMS Sasuke and below can push him nearly as far.
