NOTE: I AM NOT MINATO HATER, I LIKE MINATO VERY MUCH BUT USE LOGICAL POINT OF VIEW. NOT FANBOY' POINT OF VIEW.
Hi guys, I just read new Naruto Chapter 631 and I disappointed with some things in it.
I will split my theory in two parts. First will be about why Minato can have and has Kyuubi chakra mode and second will be while Minato can't have and isn't in Bijuu mode.
ABOUT Black markings on Minato's hand
Naruto in Bijuu mode has black marking on inside part of his hand(red circle around his hand) and Until know nowhere Minato shown to have same black marking on inside part of his hand.
ABOUT Minato's cloak looking exactly like Naruto's in Bijuu mode
Naruto's chakra cloak in Bijuu mode has holes in it(red circle marked by me)
Besides Naruto's Bijuu mode cloak has irregular shapes, as it's end are random length in different place.
While Minato's cloak:
Look's especially at red line following Minato's cloak shape, we can see that his cloak has regular shape and seems to be straightforward
ABOUT Minato's marking on his legs
As I marked in first picture, Naruto's feets have black marks as well as his legs, while in Minato's case:
Here, we see that Minato's chakra cloak lacks black marking at end of his legs(bottom part) and completly lack of black markings on his feet.
Extra !, I noticedd just that Minato doesn't have black markings on his arms as well, where BM Naruto:
Have them simply. Besides at this picture Naruto's chakra cloak is even better shown to be completly different then Minato's
^^Another proof, Naruto has black marks on his cheeks when he is in Bijuu mode, now let's look at Minato:
^^Here Minato's cheek lack black marks which further proves that he can't be in Bijuu mode but he is in KCM !
LAST THE MOST IMPORTANT THING: TO HAVE BIJUU MODE(TAILED BEAST MODE) YOU HAVE TO POSSES TAILED BEAST ITSELF SEALED INTO YOU, NOT JUST CHAKRA !
I hope that help explain why Minato is in KCM and not IN BM

Why does Minato having KCM make sense ?
First let's explain this term, I will talk about.
The Nine-Tails Chakra Mode (九尾チャクラモード, Kyūbi Chakura Mōdo)[26] is a form that Naruto gained after he separated and sealed Kurama from its chakra. He can access its chakra directly whenever he needs it without interacting with the beast at all.

Now, let's try to create formula how Kurama would be created:
Ying's half of Kurama chakra + Yang's half of Kurama chakra + mind= Kurama
Naruto=Yang's half of Kurama chakra + MIND-> smaller Kurama
Minato=Ying's half of Kurama chakra-> JUST CHAKRA
Minato has only half of Kurama chakra, without Tailed beast itself being in him. He can access it's chakra directly wheenevr he needs it and he won't have to worry about Kurama absorbing his chakra in process because he SIMPLY DOESN'T HAVE KURAMA.
Here you have Naruto in KCM with marking on his arms and most likely on his hands as well(not visible, because outside part of his hands is directed to ground)
Here we have Minato in KCM:
Minato's and Naruto's seal have same design, black markings are appearing at the same places around body and look same !.
Here we see Minato sealing Kurama chakra in himself BEFORE SEALING HIMSELF ALONG WITH HALF OF KURAMA CHAKRA IN SHINIGAMI BELLY:
Only one thing cofusing is that Minato has cloak which resembles Naruto's cloak in Bijuu mode, but in opposite to Naruto, Minato's cloak is real while Naruto has CLOAK MADE OF CHAKRA !
