Maybe he was already kage on the mission where Obito died. Its probably an error though. Its seems the entire kakashi gaiden arc timeline was messed up with the ages and Obito flashback of the chuunin exams. Which makes me think maybe Obito wasn't originally planned to be tobi and kishi sketched it all spur of the moment.
