and the Fact that he doesn't have a brother to swap eyes with means that the EMS was not originally needed and there was no side effects of the Mangekyou due to the incredibly strong Yin-Chakra inherited directly from the Sage. Plausible, though I'll share my own theory on it. Indra killed Ashura, which is why Ninjutsu spread throughout the world rather than Ninshuu but due to this, Indra's anguish after killing his younger brother caused a rift in his soul and forever cursed his descendants as kin-slayers. Which is why achieving Indra's power takes a transfer between two brothers that inherited his power (Susano'o), and why only Madara/Izuna and Sasuke/Itachi were able to achieve the Eternal Mangekyo. And why at the beginning of part 2, Kurama referred to the Uchiha as a cursed clan and warned Sasuke that if he were to kill Naruto, he would regret it.

Exactly my thought. But I think Indra used a special Fuin-Jutsu to punish himself for his sins against his own brother. In the raw it has been clearly stated, the loss of sight of the Mangekyo Sharingan has to do with a sealing.
So, if someone in Indras lineage would walk the same path, the seal would automatically punish him.
The eternal Mangekyo Sharingan arise only in those, who had a special bond to the original owner of the eyes.
