The Kyuubi was released out of Konoha, you can't sneak him into the village so Obito went in and summoned him there for surprise.

^ This. I'm really surprised that people aren't realizing this. He was skipping through time in the flashback, he didn't ACTUALLY summon the Kyuubi in the middle of a graveyard during the day. X_x
