Well it was originally madaras eyes and he transplanted them into nagatos then obito tooked them.

He can use the rinnegan due to hashiramas dna in him. But he hasnt unlocked EMS. But with the DNA his MS doesn't take near the amount of strain on him. So he really doesnt need EMS.

And Obito can't use the same abilities as madara either way because he dosn't know how to use twin Sharingan!!
