And then obito said "u are at my mercy", then madara smirked(saying in his mind ya sure i am)so thinking that madara is probably gonna try to kill obito but if they fought who would you think would win

The threads asking who would win in a fight, there's no need to worry about what happens after. But if you want to go down that route he could end up as the 10 tails jinchuuriki if he got rid of Madara, so he would no longer need his intangability, he also has the rinnengan.
