Many people believe that Madara cannot summon it because the Shin Sūsenju is a 'Kuchiyose' [Commonly known as 'Summoning'], however, no. It is not a Kuchiyose and Madara can summon it.
The Shin Sūsenju isn't a Kuchiyose, but an advanced Mokuton. In the recent chapter, Madara gained Hashirama's Sennin Mōdo which happens to be the only thing that Madara needed in order to use the Shin Sūsenju.

]- He repeats the buddha's name inside of his mind, doesn't say 'Kuchiyose'.
- Hashirama didn't draw any blood.
- No summoning circle was formed, Hashirama just slapped his hands together.
- No poof of smoke was shown.

- The Sharingan can see Chakura and copy handseals. Madara has seen Hashirama summon the Shin Sūsenju and he copied the steps with his Sharingan.
- In order to use the Shin Sūsenju, you need Hashirama's Sennin Mōdo. Madara stole it from Hashirama.
