Nope, sneak attacks work on Logias... If a logia and not prepared or taken by surprise you're screwed...
He just caught Smoker off guard while Smoker wasn't completely intangible. Here's A strawhat using Observation haki in Alabasta-

From my understanding logia need to willingly turn intangible. Intangibility is something that has a on off switch.
More experianced logias, can always keep it on.
Evidence of this is how ace stopped akaniu from just going through him, and killing both of them(luffy and ace)
But who knows.

Most likely just a 'mistake' on Odas part. We know already haki may not have even been in thought at this point in the manga.
