Last I checked Pain was defeated with SM not KSM(which does not exist as of yet)(Naruto defeated Pain not Nagato just throwing that out there)

Kishi did hint at kyuubi sage mode ,(when he talked to nagato ) but we have yet to see him use it. So until then you cant use it in a vs thread . Cause it would be mere speculation what he can do in that mode.
