Orochimaru didn't die by Sasuke. He was just taken over. He was then sealed by Itachi so technically he is still alive.

Kisame does not have his chakra leeching advantage in this fight.

As we've already seen in all of Orochimaru's fights, he does not use elemental ninjutsu. He uses taijutsu and various snake summons. Unless Kisame can absorb Orochimaru's snakes (-_-) he won't be able to replenish his chakra.
