Haven't you noticed that anyone who has used kinjutsu (forbidden techniques) have never really reprimanded for there use. A prime example would naruto and his use of multi and normal shadow clone jutsu and his use of wind-style: rasenshuriken as much as I don't want naruto to be arrested or punished in any way surely the rules must apply to all shinobi. Also kakashi has been found using shadow clone jutsu. Another example is orochimaru and his use of a multitude of forbidden techniques. Remember when the third hokage found his hide out and found orochimaru, he never arrested him but allowed him to escape.
