OT:Theoretically, yes, he should be, based on the evidence you've shown.
I can see still see Kishi getting him out of it in some way though. I feel like he could play some kind of role. Maybe spit a nasty freestyle and diss out Madara, making him pack his bags and leave

Yes but then Madara's head piece proceeded to fall down on the 1010 scrolls which could hold bigger meaning, and its very possible he is well due to some Deus Ex Machina on behalf of Kishi.
