Yeah and jiraya is stronger than the whole uchiha and 7 sword men and can kill itachi and kisame together ,kabuto faced kakashi twice and he ran away in both ,and considering Data book speed and taijutsu states ,zabuza clowns him without even setting up the mist let alone with the mist and silent killing which kabuto has no answer for .

I've used this argument before too, but with this it's a battle of attrition. Can zabuza keep the mist up longer than Kabuto can scurry underground?
I'd say if Kabuto uses that technique, it gives Zabuza the opportunity to get up to some Suiton shenanigans (clones, waterfalls to control where Kabuto can attack him from). It's a good move for a dodge, but he doesn't necessarily come out with an advantage.
Some things from part 1 shouldn't be taken so seriously.
you can't be sure that kakashi was moving completely silient ,he thought he was just an ordinary genin .Tusnade was completely out of shape in part 1 .even if we consider the pills and restrict the mist ,kabuto isn't keeping up with Zabuza ,noway kabuto with 3.5 in speed ,2.5/3.5 in taijutsu and 3 in strength would keep up with zabuza who has 4.5 in taijutsu boosted with his kenjutsu proficiency , 4 in speed and 4 in strength .And plz don't tell me physical and speed stats isn't the only factor when kabuto's whole displayed arsenal is for cqc where he is completely outclassed here let alone the mist and other suiton techniques .kakashi needed sharingan and 4 in speed in order to barely evade zabuza in the mist so .......The scan I put up shows Kabuto's ability to detect:

And with Military Pill he's got excellent reflexes, if Kakashi can avoid taking a fatal hit, Kabuto probably can:

Plus, Kabuto's resilience is excellent, he can tank a Rasengan (although it did internal damage to him from the shock):

Zabuza has to score a completely fatal hit somewhere where Kabuto isn't expecting it on the first try, otherwise Kabuto can counter. And Kabuto's counters are fully capable of incapacitating Zabuza, as he did to Tsunade before she recovered (Kabuto assumes she managed to continue moving because of her...cleavage...insulating her from the attack).

Actually, Itachi had all the reason not to want the Nine-Tails' strongest protector dead. All of Jiraiya's baseless hype came from Itachi's statements, which were obviously lies. Kisame only guessed at Jiraiya's powers. Further reaffirming this is Kisame's question after the encounter: "Why is retreat necessary... for you?". Although I have no idea how Kisame didn't find it fishy that Itachi thought Jiraiya could take on all of the Akatsuki.
Actually most of the hype came from Kisame'ss part not Itachi's ,Kisame is the one who stated Jiraya was in a different league from him (which is obviously not true ) ,Kisame is the one who stated that Uchiha clan and the 7 swordmen pale in comparison with Jiraya .
