Juubito using 3 tomoe sharingan?

Why would he have 3 tomoe instead of Mangekyou when he currently has the most chakra in the naruto universe and Senju DNA on the side with the sharingan?

My theory with absolutely no evidence and pure speculation is that when he merged with the Juubi, that part of him is no longer "Senju" DNA and is now the Juubi's will.

He can activate MS whenever he wants genius. He doesn't have EMS so it puts a strain on his eye. Im pretty sure Jubito can still lose his eyesight over overuse of his MS.

No, it has been stated in the Manga that he never had to deactivate his mangekyou because of his Senju DNA, and that he doesn't have to worry about eye strain due to it. So why is it deactivated now, when he is at his strongest?

Not really, first of all Obito not Juubito, second Obito got Senju DNA and Juubi's Chakra, its the same as EMS, he can spam Kamui forever.

OT: No MS or EMS user has ever had it active all the time. We've seen Itachi, Sasuke, Obito and even Madara with 3 tomoe sharingans, and the last two have EMS.

Jubito is no execption. It just depends on when he wants to use the technique. Having Juubi chakra doesn't mean his sharingan is supposed to always be in MS state.

He's simply not using MS. I mean firstly Obito uses it only when he goes to use a Kamui related technique or Kamui itself. Considering his recent lack of rational thought, he is simply in 3-Tomoe form.
