it was shown in the anime that kaguya created him in her final momments before her sealing. my best guess is the use of creation of all things combined with her memorys and chakra from the tree z.z so black zetsu is literly kaguya but with a slightly diffrent personality thus he is refered to as a diffrent person and addresses the real kaguya as mother
