Does person have to be alive in orochimaru body stealing justu or can orochimaru take over the dead bodys too?

They need to be alive. Orochimaru's Fushi Tensei invades their mind and supresses their consciousness, thereby taking over as the dominant personality. But it can be a double edged sword as if the person's will is strong enough, they can take over Orochimaru (e.g. Sasuke).
