Just the obvious. If you commit premeditated murder you have given up your lease on life.

does that apply to situations where it's either them or you?

Just to have a more expansive view of society, maybe? Well, I actually envy you care-free individuals. You guys can laugh whole-heartedly because you probably take everything lightly. My mind is too scarred with the various things I've seen and read for me to able to be so loose.

I do live a very relaxing life style yes. Doesn't mean I haven't been through some shit, but I get over it.

IMO anyone who tries to cover their tracks is guilty. If it was self defense either she would go to the police and turn herself in or go to a friend or family member who would call the police for her. Self defense, in the truest case would at most be tried as manslaughter, this whole self defense thing is something her lawyers came up with, which sadly happens to often making it harder for those who do something in self defense to plead it and not be convicted for a crime that they did to protect themselves or their loved ones.

If your referring to a situation where (example) your home is broken into and they are trying to kill you. Well, I hope you have enough common sense to figure this one out.

I'm questioning yours at the moment, You say if you kill you deserve to be killed back, but if the role is changed as to when your life is on the line as well it's all good.

just saying.

How is it so hard to Understand the difference between premeditated murder and self defense.

self defense doesn't even indicate killing. However there are cases when you have to defend yourself against an attacker that forces you to defense yourself to that degree. Killing them or be killed.

It can still be premeditated and alright.

No for self defense you can not have any hints of premeditation otherwise the defense won't work

OK then, what if you know beforehand they were coming to your house to kill you?

That is not premeditation, premeditation in legal terms means planning out and intent to do an illegal act. The situation you just described can still be taken care of peacefully, but if it resorts to violence a self defense legal defense would work

Jodi Arias shot her boyfriend in the face, stabbed him 29 times, then cut his throat from ear to ear. How in gods name is that self defense? Even if she did think he was about to hurt her there is no way you can do that and claim to be defending yourself. It was premeditated and self defense is not premeditated. If you think someone is coming to your house to hurt you call the cops. If it's a spur of the moment thing then shoot them. All the stuff she did was murder. She left his body naked in the shower then lied to the police and the courts.

I have never heard of this before.

If it was self-defense, it's self-defense. Nothing major or surprising there. You presented it like it was so one sided, but it sounds like it's simply self defense to the tee.

There is no way that this was self defense, with what she did to his body afterwards is just one major indication of that. This had to of been premeditated murder

Posting links is too much of a pain on my tablet.
Apparently her boyfriend, Travis Alexander, was very controlling and strange. He made her do extremely kinky things in the bedroom. One day he snapped on her, she used self-defense, and the rest is history. Part of me thinks that I'm defending her because she's physically beautiful. I hope that's not the case though. That would make me a piece of sh*t.

From the sounds of it there is more to this case than we know and judging her without all of the facts/evidence is like a 3rd grader deciding if someone is guilty or not.

Hows about we stop judging without all of the facts and let the justice system play out. If he put her life in danger and she wanted to stop then she was justified. If they both consented and she is lying than she is guilty. Without all the info about this case we cannot make a correct decision. When it comes to justice Quality > Quantity.

Here are the facts of the case:

She shot him in the face.
Then she stabbed him 29 times.
Then she cut his throat.
He was naked and unarmed.
She left his body.
She lied to authorities and says she doesn't remember things.

HOW IS THAT SELF DEFENSE?!!!
I won't say he might not have deserved it. Abusive scumbags usually do get what's coming to them. That's not self defense. You can go to court for killing a guy that beats you and abuses you sexually and get acquitted. It happens all the time. You can also and bare with me on this one...CALL THE POLICE!!! Put a woman beater in jail and they can't beat you anymore. Then we don't have problems like thi

Well do you know what he was going to do with her? Maby she thought this was the only way out, was drugged at the time, or maby she is just psycho. What happened in the bedroom and what did the investigation turn up?

Jails are so full of pot heads they toss murders and rapists out. What makes you think they will keep a woman beater in? That guy may have threatened her to keep her in that position.

Thinking it was the only way?
Half the people in jail are there because they thought it was the only way. That doesn't make it right or legal.

Was drugged?
Anything she takes is her fault. I got a buddy that doesn't remember driving his car up to the gate. That didn't keep the MPs from giving him a DUI. You think he forced her to take something? Every drug I've ever heard of being used to rape someone is a downer. Not a hallucinogen or an upper which are the only drugs that would result in violent behavior.

She's psycho?
Probably. The victims friends testified that he had complained about her stalking him and slashing his tires. She killed him while he was in the shower. The sheer anger and violence it would require to stab someone 29 times cut their throat and then when you know they're dead shoot them in the face is excessive. Then when she was questioned she just said she wasn't there. Then when they proved she was she said it was a bunch of burglars. Then she said self defense. Denial. Denial. Denial.

Jail and prison are two different things. Spending a few days in jail doesn't make you a better criminal. Its just traumatizing and makes your life suck for a while discouraging behavior. 27% of people in actual prison are violent offenders and statistically are more like to end up back in prison. The rest are druggies and triple offenders. That's a different debate for a different time though.

I am saying that the internet is the wrong place to be debating such things. So much bad info floats around and until the trial has ended some evidence will not become public.
