Hes not an jibchuuriki but EMS works in the same way as being a jibchuuriki does, his chakra fused with the chakra in Itachi's eyes like how Naruto's chakra merged with Kurama's.

You do know the way he beat orochimaru was sealing him inside the curse seal that's how sasuke could use the snake powers but itachi completely removed and sealed away orochimaru

He beat Orochimaru by using soul transfer technique on him, he performed a rikudou type feat with his Sharingan which was a foreshadowing of his potential.

But having said that, chakra and souls are linked together so Michael has a point. Being a Jin is the same as having Oro sealed in the curse mark, but nowhere near the same level.
