here are the facts.jugokudo has to hold itachi before he can pass his judgement that's when then king of hell will appear.When he does that,itachi would hit him with tsukoyomi and it would get to nagato himself.During the fight between jiraiya and pain,it was shown that the rinnegan can be caught in genjutsu and the genjutsu can get to the original pain,nagato.
