Kisame wasn't going to kill anyone might guy solos and putting your opponent in a coma is just as bad as killing. Tobi could've went back on his promise at any time the village still got flattened and if they already had hachibi tobi would've broken that promise in a heartbeat. When hiruzen revived he mentioned itachi was spying on the akatsuki yet no one knew about it. Madaras will said he was invincible. When itachi was releasing ET he said sasuke probably could have saved the clan plus he consulted hiruzen and later danzo and that's when he got the save sasuke option. Sasuke would have gotten stronger the exact same way even without itachis "help" the sound four would have kidnapped him and forced him to come.

1. he told kakashi before that happen that he wasnt there to fight
2. He saved the village 3 times and even killed his mother and father for the village
