Kabuto never once restrained madara. he actually told madara to go nuts really. he wanted to see what madara could do in his prime. there is no scan where kabuto ever restricted madara. madara could have freed himself anytime he wanted. but he did not want to because he knew kabuto would not restrict him. he only freed himself because the jutsu was releasing, not becaue he could not do it before that point. he didnt wanna leave so he broke the bonds

the blame goes on the direct person. madara made the war worse, not anyone else. kabuto helped a great deal by joining obito and rezzing madara.

itachi has no proof or inkling he knew madara was out there and thus his supposed urgency was unfounded to end the jutsu when he didnt know who was still active.
