It's quite more complicated than just that. It would go back to what truly is " a reasonable cause of invasion", The state surveillance system exists for a reason .

Yes it is a constitutional right but that doesn't mean that it's absolute, plus all counties of the world do limit the privacy of their citizens to some degree as it's only logical to do so.
